Poe Gems and Jewelry is a family gemstone business trading from Bangkok, Thailand. We sell natural loose sapphires, rubies, spinels, and finished jewellery, and we run timed online auctions. These terms are the agreement between you and us for using this website, joining our auctions, and buying from us. By using the site you accept them. If you do not agree with them, please do not use the site.
You can browse the collection without an account. To save a wishlist, request a stone, or join an auction, you create an account with your email address. You must be old enough to enter a binding contract where you live. The details you give us must be accurate and kept up to date.
Your account is yours alone. Keep your sign in details private, and tell us straight away if you believe someone else has used your account. You are responsible for what happens under it until you do. We may suspend or close an account that breaks these terms, interferes with the site or an auction, or is used dishonestly.
We describe every stone in good faith, drawing on three generations at the bench and on the reports of independent laboratories. Where a certificate is shown, it is the opinion of the laboratory that issued it, reached by their methods at the time of testing. Gemmology involves professional judgement, and different laboratories can reach different conclusions about the same stone.
Photographs and films are taken from the actual stone, but colour and brightness vary from one screen to another, and small variation in weight and measurement is part of buying natural gemstones. Nothing on the site is investment advice. If anything about a stone matters to your decision, ask us before you commit, and we will tell you what we know.
Bidding requires our approval. You apply from your account with a WhatsApp number, and we may approve, decline, or later withdraw bidding access at our discretion. Approval is personal to you and may not be shared.
Every bid is a binding offer to buy the lot at that amount. Bids cannot be lowered or withdrawn once placed. A bid must meet the minimum shown at the time it is placed. Our server clock decides when an auction opens and closes, whatever a countdown on your screen shows. When an auction closes, the highest accepted bid wins. We do not add a fee on top of your bid: the amount you bid, plus shipping and any duties described below, is what you pay.
Buy now is a request to purchase the lot at the stated price. The sale is made when we confirm it, not when the request is sent. We may reject a bid, pause or extend an auction, withdraw a lot, or cancel a sale where there has been an error, a technical fault, or conduct that undermines fair bidding, including bidding through multiple accounts or arrangements between bidders.
A winning bid must be settled within seven days of the auction closing unless we agree a different arrangement with you. If it is not, we may cancel the sale, offer the lot to another bidder or relist it, and remove your bidding access.
Prices are shown in United States dollars. We do not take payment on this website and we never hold your card details. Once a purchase is agreed, we arrange payment with you directly over WhatsApp or email, and we confirm the payment methods available to you at that point. A stone remains ours until we have received payment in full.
We arrange shipping with you as part of settlement, insured while in transit unless we agree otherwise. Import duties and taxes charged by your country are your responsibility, and we will tell you what to expect where we can.
Please inspect your purchase when it arrives. If a stone is materially not as we described it, tell us within seven days of delivery and we will put it right, by return and refund or by another remedy we agree with you. A returned stone must come back in the condition it was sent, with its certificate. Beyond misdescription, returns are agreed case by case, so ask us before buying if you need certainty about anything.
The photographs, films, text, and design of this site are ours. You are welcome to view and share links to them, but you may not copy them for commercial use without our permission. You also agree not to interfere with the site or its security, not to collect data from it by automated means, and not to create accounts under false details.
We stand behind what we sell. Beyond that, the site is provided as it is, and while we work to keep it accurate and available, we cannot promise it will always be free of errors or interruptions. To the fullest extent the law allows, we are not liable for indirect losses, lost profit, or losses we could not reasonably have foreseen, and our total liability in connection with a purchase will not exceed the amount you paid us for it. Nothing in these terms removes rights the law gives you that cannot be removed by agreement.
These terms, together with anything we agree with you in writing when a purchase is settled, are the whole agreement between us. If part of them turns out to be unenforceable, the rest still stands. If we do not enforce a term on one occasion, we may still enforce it later. These terms are governed by the law of Thailand, and the Thai courts will settle any dispute we cannot resolve together.
We may update these terms as the business grows. The date at the top shows the current version. Changes apply from when they are posted, and using the site after that means you accept them. A purchase is governed by the terms in force when it was made.
